{"id":53503,"date":"2021-05-13T16:01:20","date_gmt":"2021-05-13T16:01:20","guid":{"rendered":"https:\/\/merryjane.com\/cherokee-nation-just-decriminalized-weed-possession-in-state-where-pot-is-still-illegal\/"},"modified":"2021-05-13T16:01:20","modified_gmt":"2021-05-13T16:01:20","slug":"cherokee-nation-just-decriminalized-weed-possession-in-state-where-pot-is-still-illegal","status":"publish","type":"post","link":"https:\/\/merryjane.com\/news\/cherokee-nation-just-decriminalized-weed-possession-in-state-where-pot-is-still-illegal\/","title":{"rendered":"Cherokee Nation Just Decriminalized Weed Possession in State Where Pot Is Still Illegal"},"content":{"rendered":"<p><em>Image <\/em><a href=\"https:\/\/ktul.com\/news\/local\/cherokee-nation-reopening-covid-19-emergency-assistance-program\" rel=\"nofollow noopener\" target=\"_blank\"><em>via<\/em><\/a><\/p>\n<p>The Eastern Band of Cherokee Indians tribal council, which oversees Native communities located on the western edge of North Carolina, has voted to decriminalize the possession of an ounce of cannabis for those 21 years and older, <em>Cherokee One Feather <\/em><a href=\"https:\/\/www.theonefeather.com\/2021\/05\/council-changes-tribal-law-on-marijuana\/\" rel=\"nofollow noopener\" target=\"_blank\"><u>reports<\/u><\/a>. &nbsp;<\/p>\n<p>As a sovereign nation not subject to state laws, the tribe\u2019s decision to decriminalize cannabis possession of up to an ounce makes it the first area in North Carolina to remove marijuana possession penalties.&nbsp;<\/p>\n<p>The changes to the Eastern Band\u2019s drug code passed nearly unanimously, with 11 council members voting for the decriminalization and one only against. The resolution will now head to the council chairman and the chief to be ratified.&nbsp;<\/p>\n<p><iframe loading=\"lazy\" allowfullscreen=\"true\" frameborder=\"0\" width=\"640\" height=\"430\" scrolling=\"no\" src=\"https:\/\/merryjane.com\/embed\/gallery\/here-are-the-indigenous-nations-that-have-legalized-cannabis-in-the-united-states\/1\" ><\/iframe><\/p>\n<p>A ban on certain drug paraphernalia, including roach clips, was also rescinded, and the legal limit for hash possession also tripled from one-twentieth of an ounce. Sale and cultivation of cannabis remain illegal, however.<\/p>\n<p>The 16,000-member Eastern Band of Cherokee Indians is the largest federally recognized tribe in the eastern half of the United States. It stretches over 100 square miles in five North Carolina counties.&nbsp;<\/p>\n<p>For some council members, the decriminalization had much to do with marijuana\u2019s utility in breaking addiction to other drugs.&nbsp;<\/p>\n<p>\u201cIf we had to start all over today, alcohol would be the one that wouldn\u2019t be legal,\u201d said council member Albert Rose. \u201cCannabis is framed as a highway drug when really it\u2019s alcohol. Cannabis would actually be the exit drug.\u201d<\/p>\n<p>Opioid addiction <a href=\"https:\/\/www.newsobserver.com\/news\/state\/north-carolina\/article226289940.html\" rel=\"nofollow noopener\" target=\"_blank\"><u>has wracked<\/u><\/a> this section of Cherokee Nation, which is also referred to as the Qualla Boundary. In 2018, the Office of National Drug Control Policy named it as one of 10 \u201chigh-intensity drug trafficking areas\u201d in the United States.&nbsp;<\/p>\n<p><iframe loading=\"lazy\" allowfullscreen=\"true\" frameborder=\"0\" width=\"640\" height=\"430\" scrolling=\"no\" src=\"https:\/\/merryjane.com\/embed\/gallery\/have-you-seen-purple-weed-porn-like-this-before\/1\" ><\/iframe><\/p>\n<p><a href=\"https:\/\/www.pewtrusts.org\/en\/research-and-analysis\/blogs\/stateline\/2019\/09\/09\/in-cherokee-country-opioid-crisis-seen-as-existential-threat\" rel=\"nofollow noopener\" target=\"_blank\"><u>Hundreds of Cherokee children<\/u><\/a> were taken from prescription drug-addicted parents into tribal custody. It\u2019s estimated that three-quarters of them had to be placed into non-Native homes, effectively separating a large portion of a generation from its community.&nbsp;<\/p>\n<p>In 2015, the Cherokee Indian Hospital Authority invested in two new medical facilities to treat addiction. The tribe began a needle exchange program in 2017.&nbsp;<\/p>\n<p>Then in 2018, the tribe filed a lawsuit against opiate-producing pharmaceutical companies arguing that drug companies aimed deceptive marketing tactics at its members, and influenced doctors to prescribe extremely addictive opiates.<\/p>\n<p>Other council members commented that the decriminalization takes the tribe one step closer to a fuller version of cannabis access.<\/p>\n<p>\u201cToday\u2019s decision by Tribal Council to decriminalize small amounts of cannabis by persons 21 or older is a first step towards better meeting the needs of our citizens who use cannabis as a medicine,\u201d said Principal Chief Richard G. Sneed, who was one of the council members who submitted the order. \u201cI join those citizens in applauding the Council for its historic, compassionate and morally upright action.\u201d<\/p>\n<p>\u201cIt is a good day,\u201d said Principal Chief Sneed. \u201cI\u2019m excited that tribal leadership has taken this important first step to move us towards a medical cannabis program.\u201d<\/p>\n<p>For others, that could mean a financial boon in a time when the tribe, typically dependent on its faltering casino business, is struggling financially.&nbsp;<\/p>\n<p>\u201cNow that we are facing times for need of new revenue streams, cannabis fulfills that quest,\u201d said the Eastern Band\u2019s governmental affairs liaison Jeremy Wilson.&nbsp;<\/p>\n<p>In October, North Dakota\u2019s Oglala Sioux became <a href=\"https:\/\/mjbizdaily.com\/oglala-sioux-tribe-approves-legal-cannabis-market\/\" rel=\"nofollow noopener\" target=\"_blank\"><u>the first tribe in the country<\/u><\/a> to legalize marijuana in a state where cannabis is still considered totally illegal.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Plagued by opiate addiction, some council members see weed as a boon to the tribe&#8217;s health.<\/p>\n","protected":false},"author":2,"featured_media":53504,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[3036],"tags":[],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v22.5 -
